عنوان فارسی بررسی قاعده فقهی «حرمت اکل مال به باطل» از دریچه حقوق و اقتصاد
چکیده فارسی مقاله قاعده فقهی حرمت اکل مال به باطل به عنوان یک اصل کلی حقوقی که سر منشاء بسیاری از قواعد فقهی و مواد قانونی است، ریشه در مبانی اخلاقی و اقتصادی دارد. لذا ضرورت دارد در کنار مبانی اخلاقی و نگاه از دریچه حقوق سنتی ، بعد اقتصادی و لزوم کارایی اعمال این قاعده نیز از زاویه میان رشته ای حقوق و اقتصاد مورد ارزیابی قرار گیرد. توجه به این مسئله که تا چه حد نیازهای اقتصادی جامعه در ایجاد این قاعده فقهی نقش داشته اند، آیا به طور مطلق اعمال این قاعده و مواد قانونی که ریشه در قاعده مذکور دارند، از لحاظ اقتصادی توجیه پذیر است یا اینکه ضرورت کارایی اقتصادی این قاعده فقهی، دامنه اعمال این قاعده را محدود می سازد، سوالاتی هستند که پاسخ به آنها به شفافیت کارکرد عملی قاعده حرمت اکل مال به باطل در بازار و جامعه کمک خواهد کرد.

چکیده انگلیسی مقاله The legal principle of prohibition of consuming property wrongfully as a general legal principle, which is the basis for many of the jurisprudential rulings and legal articles, is rooted in ethical and economic principles. It is essential that along with the ethical principles and from the perspective of traditional law, the economic dimension and the necessity of the efficiency of applying this rule to be studied from an interdisciplinary angel of law and economy, as well. Drawing attention to the questions as to what extent the society’s economic needs have played a role in creating this legal principle, whether applying this principle and the legal articles rooted in this principle are absolutely justifiable, or whether the necessity of economic efficiency of this legal principle would restrict the range of applying this principle, are the questions that this paper has addressed with economic qualitative analysis of the above-mentioned principle; and answering them will help clarifying the practical function of the principle of the prohibition of consuming property wrongfully in market and society.
