عنوان فارسی بررسی انتقادی حاکمیت حقوقی ساختار فنی اینترنت بر فضای مجازی
چکیده فارسی مقاله چکیده فضای مجازی عرصۀ نوپایی در زمینۀ حقوق است. بنابراین، هرج و مرج و فقدان نظم ناشی از حقوق را به ‏وضوح در آن می‌توان دید. دربارۀ امکان حاکمیت قانون در فضای مجازی، گروهی اعتقاد دارند که با احکام سنتی می‌توان ناهنجاری‌ها را هدایت کرد و گروه دیگر نیز قائل هستند که فقط با سازوکارهای حقوق بین‌الملل باید به چنین ‏هدفی دست یافت. اما دستۀ سوم اعتقادی به حکم و فرمان ندارند. ایشان با استناد ‏به سرشت خاص این فضا، دخالت دولت را انکار می‌کنند. در میان گروه اخیر، برخی قائل به حاکمیت ساختار فنی ‏فضای مجازی هستند. ایراداتی از این دست را می‌توان به این تحلیل وارد ساخت: این رویکرد نه فقط راهی را برای حل مشکلات پیش پای نمی‌گذارد، بلکه سبب می‌شود فضای ‏مجازی شبیه دوران قبل از مدنیت باشد و انسان‌ها با اقدامات شخصی به حق خود ‏نایل آیند. بنابراین، نباید فرمان و دخالت مقام آگاهانه و برتر را انکار کرد، اما دخالت تک ‏تک دولت‌ها نارواست و همکاری همۀ کشورها را با عنایت به وضعیت موجود می‌طلبد.‏

چکیده انگلیسی مقاله Critical Study of Internet Technical Structure as an Instrument Governing Cyberspace Abdollah Rajabi Nasrin Tarazi Abstract Cyberspace is a new era of human living and doesn't have any background in his long life. There are many disagreements among legal thinkers on recognition of legal rules for the cyberspace and its control through law or legal mechanisms. A group of lawyers belive on territoriality of cyberspace; but many of them presume regulation of internet and the legal relations arising from its function through international law and its mechanisms. The third category of legal experts articulate the nature of cyberspace is not conform with legal commands and lawmaking; so we must recognize its essence and respect for all customs and facts; among of these experts, some thinker interested for technical structure of internet and suppose that it plays role similar to law. Regarding these views, we think that the recognition of legal role of internet technical structure results to self-help system and anarchy and lead us to the time before civilization. Thus cyberspace requires legal rule and command; obviously, no satte can control this space lonely, with the exception of international cooperation of all states.
