عنوان فارسی الزامات و راهکارهای ایجاد نهاد ملی حقوق بشر در جمهوری اسلامی ایران (در پرتو قانون اساسی، حقوق بشر اسلامی، اعلامیه پاریس و رویه کشورها)
چکیده فارسی مقاله اکبر طلابکی طرقی1**، محمدصالح عطار2*** 1. استادیار مرکز مطالعات عالی انقلاب اسلامی دانشگاه تهران، تهران، ایران 2. دانشجوی دکتری حقوق بین‏‌الملل دانشگاه تهران، تهران، ایران   دریافت: 30/11/1395                                        پذیرش: 21/2/1396 چکیده نهاد ملی حقوق بشر تأسیسی دولت- نهاد اما با ترکیب غیردولتی و کارویژه‏ی نظارت بر حکومت است که برخی کشورها در سطح ملی با هدف حمایت از حقوق بشر ایجاد کرده‏اند و جمهوری اسلامی ایران نیز به ایجاد آن -مطابق اصول اعلامیه‏ی پاریس- تعهد داده است. این مقاله در مقام پاسخ به این پرسش است که «مبنا و راهکار تأسیس این نهاد در نظام حقوقی کشورمان چیست؟». ازاین‏رو با استفاده از روش توصیفی-تحلیلی و با استناد به قانون اساسی، اعلامیه‏ی حقوق بشر اسلامی و بررسی تجارب سایر کشورها، اولاً، امر به معروف و نهی از منکر دولت از سوی مردم -مندرج در اصل 8 قانون اساسی- را ضامن رعایت حقوق بشر و ملت در جامعه‏ی اسلامی و مبنای مناسبی برای ایجاد نهاد ملی معرفی کرده است؛ ثانیاً برخی از نهادهای موجودِ دارای کارویژه‏ی مشابه با نهاد ملی در کشورمان را در صورت تغییر ساختار قانونی یا استفسار از شورای نگهبان قابل انطباق بر اصول اعلامیه‏ی پاریس دانسته است؛ ثالثاً ابتکار قانون مؤسس نهاد جدید را از طریق ارائه‏ی لایحه‏ی قضایی یا طرح مجلس یا مصوبه‏ی شورای عالی امنیت ملی (به‏طور موقت) ممکن می‏داند. واژگان کلیدی: اصل 8 قانون اساسی، اعلامیه‏ی پاریس، امر به معروف و نهی از منکر، حقوق بشر اسلامی، نهاد ملی حقوق بشر.     * این مقاله برگرفته از یک پروژه کاربردی بوده و نیز با هماهنگی (مجوز) کنگره بین المللی علوم انسانی اسلامی به این نشریه ارسال شده است. **نویسنده‏‌ی مسئول   E-mail: Tala@ut.ac.ir   ***E-mail: Mohasa257@yahoo.com

چکیده انگلیسی مقاله Akbar Talabaki Toroghi1* & Mohammad Saleh Attar2   1- Assistant Professor, Supreme Studies Renter of Islamic Revolution of  Tehran university 2- Ph.D student of internationnal law, Tehran university Abstract The National Human Rights Institution is a government-institution establishment, but with a non-governmental structure and the mission to monitor the state which is established in some countries to protect the Human Rights at the national level. The Islamic Republic of Iran is also obliged to establish such institution in accordance with the principles of the Paris Declaration. This article seeks to determine the basis and the strategy for the establishment of this institution in the legal system of Iran. The results of this article, using the descriptive-analytic method and based on the Constitution, the Islamic Human Rights declaration and the experiences of the other countries, indicate firstly, "enjoining what is right and forbidding what is wrong" set forth in the Article 8 of the Constitution guarantees the compliance of Human Rights in the Islamic society and introduce an appropriate basis for establishing a national institution; Secondly, some of the existing entities also with the mission of the National Human Rights Institution are compatible with the principles of the Paris Declaration in case of legal structural alteration or interpretation of the Guardian Council; and thirdly, the initiative of the founding law of the new entity is possible through the presentation of a judicial bill or a bill of the parliament or the resolution of the Supreme National Security Council (temporarily).   *E-mail: Tala@ut.ac.ir
