عنوان فارسی بررسی نظریه‌‌ی تفکیک قوا در جمهوری اسلامی ایران با نگاهی به رابطه‌‌ی ولایت‌ فقیه با تفکیک قوا
چکیده فارسی مقاله علی شیعه‏علی1*، وحید زارع2**   1. : استادیار دانشگاه آزاد اسلامی واحد شیروان، خراسان شمالی، ایران 2. کارشناس ارشد حقوق عمومی دانشگاه تهران، تهران، ایران   دریافت: 22/1/1396                                          پذیرش: 23/5/1396 چکیده نظریه‏ی تفکیک قوا در جمهوری ‏اسلامی ‏ایران پذیرفته شده است، این مسئله از لابه‏لای قوانین و نظریات شورای نگهبان برداشت می‏شود. اما اجرای نظریه‏ی مذکور در برخی موارد ابهاماتی دارد و در مواردی مرز میان محدوده‏ی اختیارات قوا مورد تردید است، ازاین‏رو شورای نگهبان در مقام نهاد تفسیر قانون اساسی و همین‏طور ناظر بر مصوبات کشور با ورود به موضوع، اقدام به حل اختلاف میان قوای سه‏گانه می‏کند. موضوع این مقاله بررسی ماهیت نظریه‏ی تفکیک قوا و تحلیل برخی از مهم‏ترین موارد تداخل ظاهری اختیارات قوای سه‏گانه و نظریات شورای نگهبان در این زمینه است و نتیجه اینکه در مصادیقی که احتمال ایجاد تداخل ظاهری در اختیارات قوای سه‏گانه وجود دارد، شورای نگهبان در مقام نهاد تفسیر قانون اساسی اختلاف میان قوای سه‏گانه را رفع و قوای حاکم در مسئله را مشخص می‏کند. این اصل براساس ساختار نظام سیاسی جمهوری ‏اسلامی ‏ایران بیشتر برای سازگار کردن قوای سه‏گانه کاربرد دارد، ازاین‏رو با توجه به ساختار حکومتی ایران و حضور نهاد ولایت ‏فقیه و اقتدار کاملش بر همه‏ی ارکان قدرت، برداشت مدرن از نظریه‏ی تفکیک قوا نمی‏تواند پذیرفته شود و باید همان جنبه‏ی سنتی این اصل مدنظر قرار گیرد. به‏علاوه تفکیک قوا براساس قانون اساسی مسئله‏ای نسبی است. این مقاله به روش توصیفی‏-تحلیلی نگاشته شده است.     E-mail: Shiaali@mshdiau.ac.ir                                                                                           * نویسنده‏ی مسئول  **E-mail: Zare.v.69.low@gmail.com

عنوان انگلیسی Scrutiny on the Theory of Separation of Powers in the Islamic Republic of Iran with a View to its Relation with Velayat-e-Faqih
چکیده انگلیسی مقاله Ali Shia Ali1* & Vahid Zare2 1- Assistant Professor, Islamic Azad University of shirvan 2- Master of public law, Tehran University Abstract The theory of separation of powers is accepted in the Islamic Republic of Iran, inferred from the statutes and the Guardian Council's opinions. Nevertheless, implementation of this theory is faced with some ambiguities and the boundary among the scope of tasks of the triple powers is not obvious. Hence, the Guardian Council as the formal Constitutional interpreter as well as the institution for reviewing the Constitutionality of the enactments of the Islamic Consultative Assembly resolves the disputes among the triple powers. The subject of this article is to study the essence of the theory of separation of powers and to analyze some of the most important seeming interference of the tasks of the triple powers, and the Guardian Council's opinions in this regard. As the result, the Guardian Council resolves the disputes of the triple powers as the interpreter of the Constitution in cases there exists the possibility of seeming interference in the tasks of triple powers. The principle of separation of powers based on the political structure of the Islamic Republic of Iran is used to make compatible the triple powers. Therefore, regarding the governmental structure of Iran and the existence of Velayat-e-Faqih (the Supreme Leadership) and its full authority on all pillars of power, the modern approach of the theory of separation of powers could not be accepted and the traditional approach should be considered in this respect.
