عنوان فارسی ادله‌ی تقدّم نوعی امارات قضایی بر امارات قانونی
چکیده فارسی مقاله در عصر کنونی، اجرای عدالت قضایی بدون بهره برداری از منابع علمی جدید پزشکی قانونی مبتنی بر فن آوری­های نوین، تا حدودی دشوار است. در عصر حاضر داده­های آزمایشگاهی به عنوان یکی از مصادیق مهم ادله علمی اثبات جرایم از زمره امارات قضایی به شمار می­روند که در پرتو پیشرفت علم در سال­های اخیر افق­های نوینی از کشف علمی _تجربی جرایم را به روی بشرگشوده است. این امارات در واقع نوعی دلیل غیر مستقیم و مبتنی بر مشاهدات عینی و به تشخیص قاضی است که حاصل آن علمی می­ باشد که در موضوع شکواییه برای او تحصیل می ­شود و منجر به صدور رأی بر وقوع و یا عدم وقوع جرم توسط متهم می­گردد. اهمیت امارات تجربی طبی زمانی بیشتر می­ شودکه به دنبال پاسخ به این پرسش باشیم که در چه صورتی و با چه مبنایی امارات قضایی مبتنی بر داده­های آزمایشگاهی بر امارات قانونی که علی­القاعده از ظنون معتبرند مقدم می­گردد. باعنایت به اهمیت موضوع و فرضیه این مقاله مبنی بر تقدم داده­ های پزشکی بر امارات قانونی­، باید مبانی تقدم داده ­های آزمایشگاهی به عنوان امارات قضایی مشخص شود. در این نوشتار که از نوع توصیفی - تحلیلی و با ابزار کتابخانه ای تنظیم گردیده، مبنای تقدم اماره قضایی مبتنی بر داده­ های آزمایشگاهی بر امارات قانونی در پرتوی تبیین جایگاه ادله اثبات و تعریف امارات و  بیان وجوه افتراق دو اماره قانونی و قضایی و اعتبار داده ­های آزمایشگاهی در فقه و حقوق بررسی گردیده است. این مقاله نتیجتاً ثابت کرده است علیرغم تقدم رتبی و نوعی اماره قانونی بر امارات قضایی در شرایط عادی و متعارف، داده ­های آزمایشگاهی به عنوان اماره قضایی بر امارات شرعی و قانونی، به دلیل تولید علم و کاشفیت هر چه بیشتر مورد اتهام از طرفی و طریقت ادله اثبات دعوا درحقوق وفقه امامیه از طرف دیگر و حجیت علم قاضی در جهت سوم، تقدم را حداقل به صورت قضیه موجبه جزئیه، موجه می­ نماید.

چکیده انگلیسی مقاله In the current era ، despite the complexity and variety of crimes against humanity,  judicial  justice without tapping new sources of forensic science and new technologies is somewhat difficult. In the age of information and communication technologies, laboratory data as one of the important examples of evidence of crimes are one of the legal indications due to the progress of science in recent years. The prospect of a new scientific discovery has opened crimes to humanity. In fact, this indication is an indirect reason based eyewitness and vote judge that the result in science is the subject of complaint leading to a decision on the occurrence or non-occurrence of the crime by the accused. Important medical- experimental indications more time that we are looking for answers to these questions that in what form and with what basis come first, legal indications based on laboratory data that primarily are of valid guess. Considering the importance of this issue and assumption of this article based on priority of medical data on legal indications must be specified. This descriptive and analytical article that was set with library tools, reviewed radix of priority of the legal indications based on laboratory data under explain of position of evidence of proof  and definition of indications and express aspects of difference of judicial and legal indications and validity of laboratory data in law and jurisprudence and accordingly has proven to be despite of  priority intermittent and typical legal indications on judicial indications under normal conditions. Laboratory data serve as judicial indications on legal indications is the first because of science production and more fact finding and of access of reasons of proof in Emam Law and jurisprudence and judge's knowledge validity.
