عنوان فارسی سازوکارهای حقوقی تعامل اصناف با دولت و ضعف نهادمندی اتحادیه‌های صنفی در ایران
چکیده فارسی مقاله در این نوشتار، تمرکز بر تحلیل سازوکارها و الزامات حقوقی در ارتباط با روابط اتحادیه‌های صنفی با دولت، کاستی‌ها و ضعف نهادمندی این روابط در ایران است. این مطالعه به صورت بین رشته‌ای در ذیل حقوق عمومی و علوم سیاسی صورت گرفته است. مهم‌ترین پرسش‌های این تحقیق عبارت‌اند از: مهم‌ترین الزامات حقوقی در فعالیت و تعامل اصناف با دولت در ایران در دو دهه اخیر کدامند؟ مهم‌ترین متغیرهای مؤثر بر عدم موفقیت کامل اتحادیه‌های صنفی و تعامل ضعیف آن‌ها با دولت در ایران چه بوده‌اند؟ در پاسخ باید گفت که در قانون نظام صنفی و قانون اساسی ایران، الزامات، تمهیدات و فرصت‌های لازم برای فعالیت اتحادیه‌های صنفی، عمدتاً پیش‌بینی شده‌اند لذا عدم موفقیت کامل اتحادیه‌های صنفی را باید در متغیرهای سیاسی، تشکیلاتی-سازمانی و متغیرهای جامعه شناختی جستجو کرد. البته در این نوشتار، موفقیت‌های نسبی عملکردی و پیشرفت‌های تشکیلاتی اتحادیه‌های صنفی نادیده گرفته نشده‌اند ولی با نقطه مطلوب، فاصله نسبتاً زیادی وجود دارد.

چکیده انگلیسی مقاله Abstract In this article, the emphasis has been on analysis of the mechanism and legal obligations about reations of guilds and professional ::union::s with state, their deficiencies and weak institutionalizing of this relation in Iran. This study has been conducted by interdisciplinary manner in two courses of public law and political sciences. The main questions in this article are: What are the important legal mechanism and obligations on the activities and interaction of guilds with state in Iran in two last decades? What have been the important efficient variables on the non-full successfulness of professional ::union::s and their weak interaction with state in Iran? In answer must be said that: in the professional system law and the constitution, have been articulated the obligations, preconditions and necessary opportunities for the activities of professional ::union::s, and then, Must try to find the reasons of non-full successfulness of these actors in political, organizational and sociological variables. Of course, in his article, have not been denied the relative practical successfulness and organizational advancement of them, but have nearly much distance with ideal type.
