عنوان فارسی بررسی حکم پذیرش ولایت جائر به قصد امر به معروف و نهی از منکر
چکیده فارسی مقاله پذیرش ولایت جائر به‌رغم تأکید نصوص دینی بر حرمت آن، در مواردی جایز قلمداد شده است و این جواز یا مستند به نصوص دینی است و یا مطابق برخی از قواعد کلی پذیرفته‌شده نزد فقهاست؛ در این نوشتار با مراجعه به متون فقهی این نکته به دست آمده که موارد جواز پذیرش ولایت جائر، وسیع‌تر از آنچه است که در نصوص به آن اشاره شده یا بر قواعد کلی منطبق شده است. پذیرش ولایت جائر به‌قصد «امر به ‌معروف و نهی از منکر» با قید اینکه بدون پذیرش سِمَت از سوی جائر، عمل به این دو واجب الهی میسَّر نباشد از مهم‌ترین مواردی است که به‌رغم ذکرنشدن آن در نصوص دینی و مطابقت‌نداشتن با قواعد کلی سامان‌یافته در متون فقهی به‌عنوان یکی از اسباب روایی پذیرش ولایت جائر محسوب و مورد پذیرش مشهور قریب به اتفاق فقها واقع شده است. نوشتار پیش رو به سنجه‌های مورد استناد مشهور فقها درحکم به جواز پذیرش در صورت مزبور پرداخته و با نقد و بررسی آن و ادلۀ مخالفان، به شیوۀ دیگری به حل این مسئله دست یافته است.

عنوان انگلیسی A Study on the Precept of Accepting the Oppressor's Rule with the Purpose of Enjoining the Right and Forbidding the Wrong
چکیده انگلیسی مقاله Accepting the oppressor's rule, in spite of the emphasis of religious texts on its prohibition, has been permitted in some cases and such permissibility is either based on religious texts or in accordance with certain rules admitted by Islamic jurists. In the present paper, through referring to jurisprudential texts, it has been concluded that cases of permitting the oppressor's rule are wider than the cases mentioned in the texts or which have been considered as instances of the general rules. Accepting the oppressor's rule with the purpose of enjoining the right and forbidding the wrong, provided that without accepting the authority proposed by the oppressor, complying with these two divine obligations won’t be possible, is one of the most important cases which, although not mentioned in religious texts and not being in accordance with the general rules established in jurisprudential texts, is regarded as a cause of the admissibility of accepting the oppressor's rule and has been admitted by the vast majority of famous Islamic jurists. The present paper has dealt with the criteria relied upon by Islamic jurists in authorizing the acceptance of the oppressor's rule in the above said case and by criticizing and reviewing it and the arguments of opponents, has achieved another way to solve this problem.
