عنوان فارسی تبیین نقش نهاد حل اختلاف سازمان تجارت جهانی در توسعه حقوق بین‌الملل
چکیده فارسی مقاله پیدایش نهاد حل اختلاف سازمان جهانی تجارت به‌عنوان یکی از ارکان یک سازمان بین‌المللی در زمینه فیصله اختلافات بین‌المللی در حوزه تجاری یک تحول و پدیده نوین در حقوق بین‌الملل محسوب می‌گردد. این تحول حاصل یک فرایند تکاملی است که از جهات مختلفی ساختار و بدنه نظام حقوق بین‌الملل و برخی مفاهیم آن را تحت تأثیر قرار داده و موجب گسترش آن از حیث اجرای مقررات حقوق بین‌الملل در میان تابعان بیشتری از حقوق بین‌الملل و از حیث توسعه برخی نهادهای حقوق بین‌الملل در حوزه ساختاری این نظام گردیده است. نهاد مذکور، مبتکر آیین جدیدی در روش حل اختلاف در نظام حل اختلافات بین‌المللی به طور کلی و در حوزه حل اختلافات تجاری، به طور خاص گردیده که در مجموعه‌ی نظام حقوق بین‌الملل بی‌نظیر می‌باشد. این نهاد، از یک سو، به منزله یک بازیگر فعال در ساختار کلی نظام حقوق بین‌الملل و به مثابه یک مرکز دیپلماتیک، با توسعه صلاحیت اجباری میان اعضای سازمان، نقش موثری در گسترش حقوق بین‌الملل در حوزه حل اختلافات بین‌المللی ایفاء نموده و از دیگر سو، این نهاد با ارکان و عملکرد منحصر به خود، چند مرحله‌ای کردن رسیدگی‌ها، زمان بندی مراحل رسیدگی، دقت و سرعت در حل و فصل اختلافات بین‌المللی، این نظام را توسعه داده و اجرای آرا نهاد حل اختلاف را تضمین نموده است.

چکیده انگلیسی مقاله The emergence of the WTO Dispute Settlement Body as one of the pillars of an international organization in the field of international dispute resolution in the field of trade is a new development and phenomenon in international law. This evolution is the result of an evolutionary process that in various ways has affected the structure and body of the international legal system and some of its concepts, and has led to its expansion in terms of the implementation of international law among more subjects of international law and in terms of The development of some institutions of international law has been in the structural field of this system. This institution has initiated a new religion in the method of dispute resolution in the international dispute resolution system in general and in the field of commercial dispute resolution, in particular, which is unique in the system of international law. On the one hand, this institution, as an active player in the general structure of the international legal system and as a diplomatic center, has played an effective role in the development of international law in the field of international dispute resolution by developing mandatory competence among its members. On the other hand, this institution has developed this system with its unique elements and functions, multi-stage proceedings, timing of proceedings, accuracy and speed in resolving international disputes, and has ensured the implementation of the opinions of the Dispute Settlement Body.
